Litigation Risk: An SWD Monitoring Firm Has Sued Their Biggest Customer After The Customer Transitioned To An In-House Design

SitePro is suing a large water midstream firm, claiming that their proprietary SWD monitoring system was responsible for over $1bn in fund raising by their customer and the customer's growth from 2 wells to >60 before their customer transitioned to an internally developed system. As the water midstream firm achieved scale, it felt it wasn't getting the optimization and responsiveness that it needed from the third-party system so an in-house replacement was built, which SitePro alleges cloned trade secrets in a 43-page complaint that is heavy on marketing material and was filed in the US District Court for the Western District of Texas Waco Division a couple weeks ago. This new legal spat highlights a litigation risk to growing midstream firms that transition from deeply embedded third-party IoT systems to solutions built in-house.
